WHAT IS CRIMINAL LAW?

Criminal law is the area of public law that regulates the punitive power of the state. This is based on a factual assumption (criminal behavior), which is connected with a legal consequence (punishment). Criminal law is divided into two categories: substantive and formal law. The substantive criminal law is formed by describing the behaviors considered criminal (they are included in the Criminal Code), and the criminal law is a formal criminal procedural law governing the procedure of application of substantive criminal law (by law) within the criminal proceedings.
